This Site is operated by All The Fauna LLC. By visiting the Site or placing an order, you agree to be bound by these Terms of Service, and our Privacy Policy, including our Cookie Policy. We may update these Terms at any time; continued use after changes are posted means you accept them.

1. Eligibility and prohibited uses

You must be of legal age in your jurisdiction, or have a parent/guardian's consent, to use the Site. You may not use the Site for any unlawful purpose, to transmit harmful code, to infringe intellectual property, to harass others, or to collect personal information about other users without consent. We may suspend or terminate access immediately for violations.

2. General conditions

We reserve the right to refuse service to anyone, for any lawful reason, at any time, and never based on a protected characteristic under applicable anti-discrimination law, including California's Unruh Civil Rights Act. Content on the Site may be transmitted unencrypted, but payment card information is always encrypted by our payment processor. You may not reproduce, duplicate, copy, sell, or exploit any part of the Service without our written permission.

3. Product information and pricing

Product descriptions, images, and pricing are provided for general reference. We don't guarantee that colors will display accurately on every monitor, and we reserve the right to limit sales by quantity, person, household, or region, and to change prices without notice. We may discontinue products or the Service at any time.

4. Orders and billing

We may refuse or limit any order. You agree to provide current, complete, and accurate purchase and account information. If we believe an order was placed in error or involves fraud, we may cancel it and issue a refund without prior notice.

5. Nonprofit Funding Program

Nonprofit rescue partners in our Nonprofit Funding Program earn a referral commission on sales made through their unique shopping link, as described on the Site. Participation as a Partner in our affiliate/referral program is governed separately by our Partner Terms & Conditions, presented at sign-up through our Nonprofit Funding Program's hosted portal.

6. Reviews and user submissions

If you submit reviews, photos, or other content (through our review platform or otherwise), you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, publish, and display that content in connection with the Site and our marketing, and you confirm you have the right to grant that license. We may remove or decline to publish any submission at our discretion, and are not obligated to pay compensation for user submissions. If your submission includes your likeness, your family's likeness, or your pet's likeness, this license also covers our use of that likeness in connection with the Site and our marketing, and you confirm you have the right to grant this on behalf of everyone depicted — including that any minor shown has the consent of a parent or legal guardian.

7. Third-party links and tools

The Site may link to third-party websites or offer optional third-party tools; we don't examine or endorse them and aren't responsible for their content, accuracy, or your dealings with them.

8. Disclaimer of warranties

The Service and all products delivered through it are provided "as is" and "as available," without warranties of any kind except as expressly stated in writing or required by law. To the extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. Some states do not allow the exclusion of certain implied warranties, so this exclusion may not apply to you, and nothing in this section limits any warranty that cannot be disclaimed under applicable law, including the implied warranty of merchantability under California's Song-Beverly Consumer Warranty Act where it applies to your purchase.

9. Limitation of liability

To the maximum extent permitted by law, All The Fauna LLC is not liable for indirect, incidental, punitive, special, or consequential damages of any kind arising from your use of the Service or any products purchased through it, even if advised of the possibility. Our total liability for any claim is limited to the amount you paid for the product giving rise to the claim.

10. Indemnification

You agree to indemnify and hold All The Fauna LLC harmless from any claim or demand, including reasonable attorneys' fees, made by a third party due to your breach of these Terms or violation of any law or the rights of a third party.

11. Copyright and DMCA

All Site content is protected by copyright. If you believe your copyrighted work has been used in a way that infringes your rights, send a written notice to info@allthefauna.com including your signature, identification of the copyrighted work, and the location of the allegedly infringing material. Our designated agent to receive notices of claimed infringement under the Digital Millennium Copyright Act (DMCA) is: All The Fauna Administrator, PO Box 21 – Woodland Hills, CA 91365.

12. Governing law and venue

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. You agree that any dispute will be brought exclusively in the state or federal courts located in Los Angeles County, California, and you consent to personal jurisdiction there.

13. Dispute resolution, arbitration, and class action waiver

Most disputes can be resolved by contacting us first at info@allthefauna.com, and we encourage you to try that before anything else.

For any dispute not resolved informally within 60 days, you and All The Fauna LLC agree to resolve it through binding, individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules and Mediation Procedures rather than in court, except that either party may bring a qualifying individual claim in small claims court instead. You and All The Fauna LLC each waive the right to a jury trial and to participate in a class, collective, or representative action.

Opt-out. You may opt out of this arbitration agreement by emailing info@allthefauna.com within 30 days of your first order or account creation, stating clearly that you opt out of arbitration. If you opt out, disputes will be resolved in the courts identified in Section 12, and the class action waiver above no longer applies to you.

Severability of this section. If the class action waiver is found unenforceable for a particular claim, that claim — and only that claim — may proceed in court rather than arbitration; the rest of this section remains in effect.

14. Force majeure

We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including acts of God, natural disasters, labor disputes, shipping carrier delays, supplier or print-on-demand fulfillment disruptions, internet or utility outages, or government action. Our obligations are suspended for the duration of such an event.

15. Risk of loss and shipping

Risk of loss and title for products you purchase pass to you upon our delivery to the shipping carrier. If a package is lost, stolen, or damaged in transit, contact us at info@allthefauna.com — we'll work with you and the carrier on a resolution, but the carrier's own terms and any purchased insurance govern liability for shipments once they leave our fulfillment partner's control. See our Refund Policy for how we handle damaged or defective items.

16. Electronic communications and recordkeeping

By using the Site, you consent to receive communications from us electronically, including emails and site notices. You agree that any agreement, notice, disclosure, or other communication we provide electronically satisfies any legal requirement that it be in writing.

17. Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction, including in connection with a merger, acquisition, or sale of assets.

18. Severability and entire agreement

If any provision of these Terms is found unenforceable, the remaining provisions stay in effect. These Terms, together with policies referenced here, are the entire agreement between you and All The Fauna LLC regarding the Site.
